General Description of the Role

 

The Regulatory and Compliance Manager is responsible for ensuring that the Company complies with its regulatory requirements, local and regional legislation and internal policies. The role is responsible for the internal governance procedures ensuring each department has properly documented control procedures in place and that these are updated appropriately. This role reports to the Managing Counsel who has primary responsibility for legal risk and compliance within the Company.


The person in this role will be responsible for identifying and ensuring compliance with legislation that impacts the Company's operations; as well as mitigating risks through the design, implementation and enforcement of compliance programs, company policies and procedures to ensure all business activities are undertaken within the boundaries of relevant laws and regulations. Collaborating with various departments to establish best practices and promoting a culture of compliance is the key objective of this role. There must also be substantial knowledge of data protection standards and best practices for compliance with the Data Protection Act.

 

There are no direct reports to this position.

 

A successful candidate must possess strong verbal and written communication skills and have the ability to interact effectively with people at all levels of the organization. They must also possess the ability to anticipate and avert downstream legal risks, have a solid grasp of sector specific rules, guidelines and regulations and experience reviewing policies. They must also be a team player, be able to prioritize effectively, and provide support for any general duties and projects. We are looking for someone who is detail-oriented, well-organized, and able to prioritize multiple high-importance activities, driving results with a strong sense of urgency.

 

Mission/Objectives


The job is done to a satisfactory level when:

• Demonstrate a high level of confidentiality in execution of duties with the ability to act in an independent manner, free of any real or perceived conflicts.

• Stay abreast of any changes to laws or sector specific regulations and keeping the rest of the company up to date with any changes through communication and training.
• Providing support to any investigations or audits into company compliance.
• Advising relevant teams on regulatory issues regarding sales, marketing, vendors, products or projects.

• Detail-oriented approach needed to recommend and implement strategic improvements on a range of data privacy and data protection issues.

 

Key Responsibilities and Activities


• Create, implement, administer, and enforce policies and procedures required for the Company to operate in accordance with the law and regulations.
• Establish and update a compliance manual.
• Advising on data protection and privacy matters and assisting the Managing Counsel in the discharge of their responsibilities on issues relating to the processing of data, and to consult, where appropriate, with regard to any other matter.

• Work closely with the Company’s appointed Data Protection Officer to manage data subject requests, data privacy policy and procedure training, and implementation of recommended appropriate organisational and technical measures to ensure the security of personal data.
• Keep up to date with, and understand, relevant laws and regulations, monitor compliance with laws, regulations and internal policies including monitor changes to local privacy laws and make recommendations where necessary.
• Educate employees and volunteers on not only the regulatory requirements but also the impact on the organisation if these aren't complied with

• Report back to business functions on current risk and compliance performance, highlighting or escalating areas of concern and contribute to robust and effective compliance controls within the organisation
• Assist in the gathering of internal information in response to regulatory requests
• Perform various general administrative duties (such as file creation and maintenance of ongoing administrative projects)

• Collaborate with other departments to create a culture of compliance.
• Assisting the Managing Counsel in the provision of regulatory and compliance advice in-house as required.
• Liaise with the Public Affairs Department and Project Managers to address regulatory compliance issues for projects

• Support internal audit requests and quarterly reporting requirements.
• Performs other job-related duties assigned from time to time

Key Relationships

 

Internal: All departments including other Group Business Units
External: Legal Firms, government departments and executive agencies (including Bureau of Standards, Ministry of Health, NEPA, Office of the Information Commissioner, Registrar of Companies, TAJ), Insurance Brokers, suppliers and external principals

 

Experience Required
• At least 5 years’ experience in a similar position in law, audit and/or risk management, compliance, or equivalent experience.

 

Education / Professional Qualifications
• Undergraduate Degree in Law, Compliance, IT Security, Audit or similar background.

• Compliance management certification

• At least one Data Protection and/or Privacy certification such as, CIPP, CIPT, ISEB, etc., (preferred).
• A Certificate of Legal Education (CLE) and/or Post-graduate Degree in Information Security, Data Privacy, Business Administration, or similar background from a recognized tertiary institution is a plus
